the american people have the right to answers. >> the vice president directly contradicted the sworn testimony of state department officials. >> trace: tonight, what the attack and its aftermath could mean in the race for the presidency. plus, the passenger arrested with a suitcase full of weapons at los angeles international airport back in court for a detention hearing. tonight, will a judge let him go or keep him locked up. >> and illegal bomb stash goes up in smoke. >> shepard: but first from fox this friday night the white house now says vice president joe biden was speaking only for himself and president obama. when the vp said we did not know diplomats in libya asked for more security there. the vice president made the comment last night at his debate with congressman paul ryan. >> we weren't told they wanted more security there.

we did not know they wanted more security there. >> shepard: earlier this week state department officials told congress they repeatedly requested more protection long before the attack on the consulate in benghazi. that attack, of course, killed the u.s. ambassador to libya and three other americans. today, governor mitt romney accused the vice president of, quote: doubling down on denial. >> when the vice president of the united states directly contradicts the sworn testimony of state department officials, american citizens have a right to know just what's going on. we're going to find out. >> shepard: well, reporters did try to find out at today's white house briefing. ed henry was there. is he our chief white house correspondent and is at the white house tonight. you asked the press secretary jay carney about this. what did he say? >> shep, he insisted, as you noted that vice president was not talking about the administration at large. he was talking about just the president and the vice president, not getting some sort of heads up about the security concerns. so i pressed him on whether

this was an attempt to sort of push the blame off on the state department. take a listen. >> would you say on libya that basically the buck stops with the state department on security then? it doesn't stop with the white house. >> that's an article made for television phrasing, ed, but the fact. >> the state department, the president can't -- basically he doesn't make those assessments is what you are saying? >> there are thousands of diplomatic personnel around the world there are countless facilities around the world. i'm saying when it comes to the number of personnel who are in place at consulates and embassies and other diplomatic facilities around the world, those decisions are appropriately made at the state department. >> last night was the one month anniversary of that terror attack, what is clear tonight is that with all these continuing investigations by the fbi, the state department and others. we still don't know a lot of the facts in the case, shep.

>> shepard: some republicans are saying that the vice president pointed a finger at the intelligence community. >> that's right. you mentioned that mitt romney went after the vice president today on the stump as well as some of mitt romney's supporters. two former bush bush officials were upset that the vice president last night suggested that this whole confusion over the last few weeks was anti-muslim video that caused this, the vice president suggested that was because of the intelligence community. well, two officials today, michael hayden as well as michael chertoff basically suggested that the administration was pushing off blame. they said in a joint statement, quote: it was clear any failure was not on the part of the intention community but on the part of white house decision makers who should have listened to and acted on available intelligence blaming those who put their lives on the line is not the kind of leadership this country needs. can i tell i i asked jay carney broadly about the intelligence here. he insisted today there was no actionable intelligence that gave the administration heads up a terror attack was coming. he also said he believes a lot

of these charges that are flying around are about politics and the election not about the fax of the case, shep. >> shepard: ed henry for us at the white house tonight. romney says he knows who won the vice presidential will debate. we will find out if voters agree. teaming up on the campaign trail tonight check up with them in the battleground state of ohio. that's coming up inside fox report. >> first, more than a month later secretary of state hillary clinton says she still does not know all of the details about that consulate attack in libya. >> to this day, to this day, we do not have a complete picture. we do not have all the answers. >> shepard: now we are learning more about the surveillance video of the compound that could help give us some answers. cath -- catherine herridge is in the d.c. newsroom tonight. >> security video taken by cameras like this one you see here at the consulate also shows there was no demonstration when the attack unfolded at approximately 9:35 p.m. the surveillance video was

force detailed to the consulatey nowhere to be found. the evacuation did not run smoothly. not enough seats on the plane to get everyone out. second plane had to be sent in from tripoli. also two military sources tell fox they believe the attack on the con salute may have been preemptive. the growing presence of the cia at that annex, shep. >> shepard: catherine herridge in washington. thank you. turkey -- town bombed in turkey happened on syria's side of the border. video shows the helicopter dropping explosives there. no evidence that turkey's fighter jets engaged the chopper. but it is a sign the escalating tensions between the two countries. reels are clearly already strained because of syrians ongoing civil war. and this week turkish officials said the air force intercepted a syrian passenger plane that, instead of passengers, was carrying a russian made military equipment. syria denied that that plane was carrying anything illegal.

baton, handcuffs and body bags. when they caught him at los angeles international airport he was wearing a bullet-proof vest and flame resistant pants. greg jared is in our newsroom tonight in new york city. i guess this is self-explanatory for the reason that the judge ordered no bail. >> you are exactly right. the feds argued this guy is a danger to the public. they apparently found evidence in the computer of harris that he could be prone to committing acts of violence against kids. well, that was enough for the judge to keep him locked up. harris' bag was packed with that frightening arsenal but only the smoke grenade is actually banned on aircraft. the knives and hatchets and all the other stuff does not violate rules for checked luggage. what was he planning to do with it all? he is not talking to the feds but his lawyer said this. >> he is a nice young man. is he shy. he is gentle. he has never caused harm to anyone. he has never threatened anyone. he has never made any aitems

[siren] >> police say somebody reported the guy was building bombs in his house so they evacuated the neighborhood just north of oakland bomb squad took the place. >> cops took the man who lived there into custody. listen to one of his neighbor creep on the block. he would be making all kinds of noise at all times of night, you know. it would be so loud, shake my house. >> shepard: investigators are trying to figure out why the guy was making these explosives in the first place. another huge blast blew an entire house apart in denver. this time they tell us it was an accident. people in the neighborhood reported they smelled gas and then all of a sudden the explosion leveled a home and damaged two others. just look at the pink foam here. can you see that? those are bits of insulation which witnesses say fell throughout the entire neighborhood like snow. a woman and her four kids went to the hospital. they are said to be doing okay now. crews are still searching for a man who is still missing under the wreckage of a

>> shepard: the defense secretary leon panetta warning today that hackers could launch an attack on the united states as the same destructive force as the attacks of 9/11. speaking to a group of executives on board the uss intrepid here in new york last night. secretary panetta says needs to do more to protect against the growing cyber threat. also revealed that hackers recently attacked saudi arabia's oil and gas company a virus called shamoon destructive assault has ever seen. >> it included a routine called wiper. coded to to self-execute. more than 30,000 computers that it infected were rendered

useless. and had to be replaced. it virtually destroyed 30,000 computers. >> shepard: this isn't the first time secretary panetta has pushed against better protections from cyber attacks. the white house has been pushing for new legislation to fight the hackers. last month republicans blocked the effort that senator john john mccain described as, quote: red tape. jennifer griffin at her post at the pentagon tonight. why did defense secretary panetta wait until this moment, he believes this is a pre-9/11 moment when it comes to the potential for a devastating cyber attack. his real message seemed to have been intended for iran. >> potential aggressors should be aware that the united states has the capacity to locate them and to hold them accountable for their actions that may try to harm america.

[cheers] >> so there is an example of trying to capitalize not so much on the substance of the debate but the mannerisms of your opposition that leaves imprint with the voters. that's what the romney campaign and republicans are hoping for where in this particular instance last night's debate democrats saying it should be substance add not style. >> shepard: president on the campaign trail and still going after governor romney. >> and substance. joe biden was in lacrosse making the argument as he did last night that mitt romney has ill alienated and put a distance between himself in the 47% who don't pay income taxes about their wanting a government handout. he hammer tfd again today. listen. >> the 47% this nation depends on to build this country.

work. you are interacting with other people. i think you are right it's a huge burden for them to overcome. >> we should know that burden by the way is huge because we are being told now local polls show that congressman behrman is at least 13 points behind brad sherman. >> shepard: i don't know how they keep behrman and sherman separate any way. >> i don't know did i. >> they are so alike at least in sounds. police in miami arrested a secret service officer after they found him passed out and apparently drunk as a skunk on a street corner. police say it happened hours after miami last night. found secret service agent or officer not far from a popular hot spot in downtown miami when a police officer tried to cuff him, the secret service officer hit him in the chin. the secret service spokeswoman would not confirm whether the officer was part of the president's advanced team saying only that he is a uniformed division officer.
